The Court of Appeal Jos division has stroke out an application for an injunction restraining the Plateau State Independent Electoral Commission (PLASIEC) from going ahead with the October 9th 2021 Local Government Elections. The Court however granted the prayer of the PDP by striking out the Preliminary Objection (PO) filed by PLASIEC seeking the court to throw out the Appeal by the PDP.
The PDP is challenging the Judgement of a State High Court which upheld the decision of PLASIEC which denied the party from participating in the October 9th 2021 LG Polls.
In their ruling, the Appeal Court premised their decision on the fact that stopping the October 9th 2021 LG Polls will give room for illegal structures, hence creating an avenue for unlawful structures to be established, same structures which the Court of Appeal and Supreme Courts have constantly frowned at, pursuant to section 7 of the Constitution of the Federal Republic of Nigeria as amended.
The Court however granted accelerated hearing to the Appeal filed by the PDP.
